Copyright & DMCA Policy

Draft, last updated October 16, 2026, not legal advice. This page is a plain-English draft and should be reviewed by a lawyer before Nibhollow launches publicly.

TODO (site owner, before launch): register a DMCA designated agent with the US Copyright Office (copyright.gov/dmca-directory, about $6 for three years) and update the agent details below to match that registration exactly. Without that registration, the DMCA "safe harbor" protection doesn't apply.

Nibhollow respects authors' rights, and we expect our users to do the same. We respond to copyright notices under the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

Reporting infringement (takedown notice)

If you believe something on Nibhollow infringes a copyright you own (or are authorized to act for), send a written notice to our designated agent (below) that includes all of the following:

  1. Your physical or electronic signature (typing your full legal name works).
  2. Identification of the copyrighted work you say is infringed (for example, the title and where it's published).
  3. Identification of the infringing material and enough information to find it, ideally the exact Nibhollow URL(s).
  4. Your contact information: name, address, phone number and email.
  5. A statement that you have a good-faith belief that the use isn't authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.

Incomplete notices may not be acted on. When we receive a valid notice, we'll remove or disable access to the material promptly and let the user who posted it know, including a copy of the notice (which may include your name and contact details).

Knowingly false claims can make you liable for damages under 17 U.S.C. § 512(f). If you're not sure whether something infringes (for example, it might be fair use or permitted fan work), consider getting advice first.

Counter-notices

If your content was removed and you believe it was a mistake or misidentification, or you have permission to use it, you can send a counter-notice to our designated agent that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it appeared before removal (the URL).
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification.
  4. Your name, address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the US, any district where Nibhollow may be found), and that you'll accept service of process from the person who sent the original notice or their agent.

We'll forward the counter-notice to the original complainant. If they don't tell us within 10 to 14 business days that they've filed a court action, we may restore the material.

Repeat infringers

We keep track of valid copyright notices. Accounts that receive repeated valid notices (generally three) will be terminated, and we may terminate an account sooner in serious cases, such as wholesale plagiarism. Strikes may be removed if a counter-notice succeeds or a notice is withdrawn.
